Terms of Service for Mountain Born

By accessing the Mountain Born website and utilizing our services, you (the "Customer") agree to the following terms. These terms form a legally binding agreement between you and Mountain Born.

1. The Mountain Born Service Model

Mountain Born is a logistics and procurement service. We do not manufacture, treat, or bottle water.

Agency & Procurement:

When you pay a "Service Deposit," you authorize Mountain Born to purchase specific water bottles on your behalf. These bottles are your personal property.

Delivery Logistics:

We act as your agent to transport your property to a state-regulated public water kiosk, refill it, and deliver it back to you.

Source Disclaimer:

All water is sourced from public kiosks regulated by the state. Mountain Born is not responsible for the chemical composition or quality of the water provided by these third-party state facilities.

2. Hygiene and Customer Responsibility

Because the bottles are your property, you retain ultimate responsibility for their safety.

Sanitization:

As a courtesy, Mountain Born cleans and sanitizes your bottles during each refill cycle. This is a voluntary courtesy service. You are solely responsible for ensuring your bottles remain in a sanitary condition.

No Swapping:

We use a tracking system to ensure you only receive your own bottles back. We do not "pool" bottles between customers.

3. Inherent Risk of Glass Equipment & Waiver of Liability

By choosing to use glass bottles for your water service, you acknowledge and agree to the following:

Fragility Warning: Glass is an inherently fragile material that can break, crack, or shatter due to impact, pressure, or thermal shock (sudden temperature changes).

Assumption of Risk: You voluntarily assume all risks associated with the possession and use of glass bottles.

Waiver of Injury Claims: Mountain Born shall not be held liable for any injuries, including but not limited to cuts, lacerations, or property damage, resulting from the breakage of glass bottles. This applies whether the breakage occurs during your handling, storage, or while the bottles are in your possession.

4. Account Closure and Equipment Return

The Service Deposit is used to secure the equipment we procure for you.

Return Requirement: Upon termination of service, you must return all bottles/equipment in good, usable condition.

Non-Return/Damage Fees: If equipment is not returned within ten (10) business days of account closure, or is returned shattered/damaged, a replacement fee will be charged.

Deduction from Deposit: Mountain Born will deduct the full replacement cost of unreturned or broken equipment directly from your Service Deposit.

5. Payments, Stripe, and Authorization

We use Stripe for secure payment processing.

Data Privacy: Mountain Born does not store your full credit card data. We only retain account metadata (name, address, phone number).

Authorization to Charge: You grant Mountain Born the right to charge your payment method on file via Stripe for:

  • Initial and recurring Service Deposits.
  • Refill and delivery fees (charged after services are rendered).
  • Replacement fees for unreturned or broken equipment.
  • Retail products (pumps, stands, etc.) purchased through our site.

6. Limitation of Liability and Indemnification

To the maximum extent permitted by law, Mountain Born’s liability is limited as follows:

We are not liable for the water quality from third-party kiosks.

We are not liable for any illness or injury resulting from the use of your bottles.

Maximum Liability: In no event shall Mountain Born’s total liability exceed the amount paid by you for the specific delivery service in question.

Indemnification: You agree to indemnify and hold Mountain Born harmless from any claims, losses, or expenses (including legal fees) resulting from your breach of these terms or injuries to third parties occurring on your property or from your equipment.

7. Force Majeure

Mountain Born is not liable for delays caused by factors outside our control, including kiosk malfunctions, state water shut-offs, extreme weather, or traffic accidents.

Acknowledgement

By completing your order, you acknowledge that you own the bottles, you are responsible for their cleanliness, you assume all risks associated with the use of glass, and you authorize Mountain Born to charge your card via Stripe for all services and equipment fees.
